Former Utah jail officer to serve time for domestic violence

A former Beaver County jail officer was fined and will spend five days in jail after he pleaded guilty to charges stemming from an alleged domestic violence incident.

Luke Malcolm Emack, 29, was also ordered to undergo a mental health evaluation after pleading guilty Wednesday in 5th District Court to attempted aggravated assault, a class A misdemeanor.

According to a probable cause statement, the former Beaver County Sheriff's deputy is accused in an Oct. 6 incident involving his girlfriend at the couple's home in Beaver. Emack and the woman had been arguing, and when he attempted to back his car out of the garage, she attempted to retrieve some items from the vehicle.

When Emack allegedly continued backing out, an open car door struck the woman, who then shut the door and threw a shoe at the car while standing at the rear of the garage. At that point, she claimed, Emack drove the car toward her, forcing her to flee to the door leading into their home.

A sheriff's deputy later located Emack, who allegedly acknowledged he had driven the car toward the woman, "spinning the tires," but only to scare her. Emack insisted he did not intend to harm the woman, according to court documents.

Judge Michael Westfall ordered Emack to the jail time, pay a fine of $1,000, obtain a mental health evaluation and complete a domestic violence assessment. His guilty plea will be held in abeyance.
