Appeal denied for Texas polygamous group member

SAN ANGELO, Texas • A West Texas polygamous group member serving six years in prison for marrying an underage girl has lost his appeal because he never paid for the legal filings.

The San Angelo Standard-Times reports the Third Court of Appeals on Tuesday rejected the appeal of 28-year-old Keith William Dutson Jr.

A jury in 2010 convicted Dutson of sexual abuse of a child. Prosecutors say the member of the Fundamentalist Church of Jesus Christ of Latter Day Saints in 2005 married a girl younger than age 16 in a church-sanctioned union, which is not an official civil marriage.

Dutson, who was being held Thursday in the Wallace Unit, was notified his appeal would be dismissed unless he paid for preparation of court records. The court declined to declare him indigent.
