Preliminary hearing set for Davis County teacher charged with rape

A preliminary hearing has been set for a Davis High School English teacher charged with rape after she allegedly had sexual relations with a then-16-year-old student.

Brianne Land Altice, 34, is charged in 2nd District Court with three counts of first-degree felony rape. She made her initial appearance in court Friday, where a preliminary hearing was set for Jan. 31. At that hearing, prosecutors will present evidence, and the judge will decide whether there is probable cause for the woman to stand trial on the charges.

According to court documents, Altice is accused of having sexual intercourse with a male student, now 17, on at least three occasions between January and September of 2013.

Prosecutors say the teacher acknowledged to investigators that she had engaged in sex with the boy on two of the three occasions in which she has been charged.

An earlier probable cause statement, filed with the Davis County jail after Altice was arrested at her South Weber home in late October, alleged that one of the trysts occurred in a Kaysville park.

She has been free on $10,000 bail since her arrest and on paid administrative leave from her teaching job.

Altice, whose husband filed for divorce and custody of their child last month, was hired by the Davis County School District in 2004; she had been teaching at the high school since August 2012.
