A man is suing the Odyssey House, claiming he fell down an open elevator shaft while he was a patient there.

In a lawsuit filed Monday, Charles Montoya claimed he was given a key to the elevator at the drug treatment center, 68 S. 600 East, while he was a patient in October 2006.

Montoya tried to take the elevator from the second floor to the ground floor, using the key to open the elevator door. However, when he stepped into the elevator, the platform remained at the ground level, and he fell into the elevator shaft, the suit claims.

The fall caused permanent damage to Montoya's knee, the lawsuit states.
