A 21-year-old Ogden man has been charged with rape after police said he got a 14-year-old drunk at a mall and then sexually assaulted her at a city park.

Police allege Daniel Garcia and a 13-year-old boy first went to the Newgate Mall and ended up meeting with two 14-year-old girls, according to an affidavit to obtain an arrest warrant filed in Ogden's 2nd District Court. It wasn't clear if the two girls knew Garcia or the 13-year-old before they met up at the mall on April 27.

The four then went outside and started drinking "a large quantity of the vodka," which Garcia had apparently brought along with him to the mall, court records show.

A short time later, one of the 14-year-olds went home with her mother, leaving the other girl alone with the teenage boy and Garcia.

The trio continued drinking and the ended up at Odyssey Park, 300 Goddard St. They then walked to a fast food restaurant, and when the 13-year-old came back out with a drink and food, he told police the girl and Garcia were making out, hugging and "fresh kissing."

The trio then returned to Odyssey Park where they continued to drink and play on the playground equipment before the 13-year-old decided to leave for about 30 minutes "in case something happened."

When he returned, he found the 14-year-old passed out from the amount of alcohol she had consumed, police said.

The two then took the girl home and placed her on her bed. Garcia immediately left, and the 13-year-old stayed around for a short time before leaving.

The girl was examined the next day for sexual assault, and police said the examination revealed injuries that were consistent with rape.

Garcia was charged Thursday with rape, a first-degree felony, and two counts of furnishing alcohol to a minor, a class B misdemeanor. He was scheduled to appear in court Tuesday.
