Posted: 9:14 AM- PROVO - A Payson man accused in the shooting of his neighbor's dog faces charges.

Kay Sherman Mortensen has been charged with animal cruelty and discharging a firearm from a vehicle.

Mortensen was in court Thursday or his pretrial conference. He has pleaded not guilty to both charges.

However, Mortensen's attorney asked to postpone the conference, saying he needed more time to collect evidence. Prosecutors agreed to give him three months to work on the case.

The incident happened in May when, police say, Mortensen shot Cindy Beddoes' Great Dane.

Beddoes says Mortensen's car drove by just as she had let her dog out of thekennel. She said her dog began barking at Mortensen, who then got out of his car. He claims the dog tried to attack him, so he fatally shot the animal.
