Sentencing has been postponed for a man paralyzed in a Bluffdale neighborhood-watch shooting convicted of having sex with a 17-year-old girl.
A jury in March convicted David Serbeck, 39, of three third-degree felony charges of unlawful sex with a minor. His May 25 sentencing before 3rd District Judge Elizabeth Hruby-Mills was pushed back to June 1 because of possible competency issues.
"The time that I've been on this case, there hasn't been this concern," Salt Lake County prosecutor Alicia Cook said after Friday's hearing. "But mental illness can rise and fall at any time."
